1. Guarantee Against Defects
1.1 KABA Australia Pty Limited (KABA) guarantees their products against defects in workmanship and materials for the period set out in the table below:
Entrance control systems
Push button locks
Workforce management hardware
Workforce management software
1.2 Provided that faults appear and a claim is made during the period of the guarantee and subject to the below exclusions, faulty goods will be repaired or replaced. KABA will not be liable for any costs other than the repair or replacement of faulty goods.
1.3 KABA may repair any faulty goods in their workshop.
1.4 The guarantee excludes:
(a) fault or deterioration due to or caused by:
(i) fair wear and tear;
(ii) climatic conditions or harsh environment;
(iii) abnormal frequency of use;
(iv) improper installation;
(v) improper use;
(vi) failure to follow installation instructions and maintenance instructions;
(vii) improper maintenance;
(viii) accident or negligence, other than by KABA;
(ix) theft or vandalism;
(b) indirect or consequential loss or damage;
(c) cost of removal or replacement;
(d) cost of freight and/or travel time.
1.5 The benefits of the guarantee are in addition to any rights and remedies of the consumer under other laws including the Australian Consumer Law.
2. Australian Consumer Law Guarantees
2.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to major failure.
2.2 Claims under the Australian Consumer Law are subject to the limitations as follows:-
(a) Insofar as goods or services supplied by KABA are not of a kind ordinarily acquired for personal domestic or household consumption, and unless the purchaser establishes that reliance on this provision would not be fair and reasonable, the liability for breach of a guarantee, condition or warranty; implied by the Australian Consumer Law is limited:
(i) in the case of goods to any one of the following as determined by KABA:-
(A) the replacement of the goods or the supply of equivalent goods;
(B) the repair of the goods;
(C) the payment of the cost of replacing the goods or of acquiring equivalent goods;
(D) the payment of the cost of having the goods repaired.
(ii) in the case of services to any one of the following as determined by KABA:-
(A) the supplying of the services again; or
(B) the payment of the cost of having the services supplied again.
3. Insofar as goods or services supplied for re-sale by KABA are not of a kind ordinarily acquired for personal domestic or household consumption, and unless the purchaser establishes that reliance on this provision would not be fair and reasonable, the liability to indemnify the re-seller implied by the Australian Consumer Law is limited to a liability to pay:
(a) the cost of replacing the goods; or
(b) the cost of obtaining equivalent goods; or
(c) the cost of having the goods repaired;
whichever is the lowest amount.
4.1 Claims pursuant to the KABA guarantee or under the Australian Consumer Law may be made to KABA in writing to the address below. You will bear your own expenses in making the claim including but not limited to postage and delivery charges.
4.2 The guarantees are given by KABA Australia Pty Limited.
